This Privacy Policy describes how simplyspanishwine.com (the “Site” or “we”) collects, uses, and discloses your Personal Information when you visit or make a purchase from the Site.

Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information that can uniquely identify an individual (including the information below) as “Personal Information”. Device information

  • Examples of Personal Information collected: version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site.
  • Purpose of collection: to load the Site accurately for you, and to perform analytics on Site usage to optimize our Site.
  • Source of collection: Collected automatically when you access our Site using cookies, log files, web beacons, tags, or pixels.
  • Disclosure for a business purpose: shared with our processor Shopify.

Order information

  • Examples of Personal Information collected: name, billing address, delivery address, payment information (including credit card numbers), email address, and phone number.
  • Purpose of collection: to provide products or services to you to fulfil our contract, to process your payment information, arrange for delivery, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
  • Source of collection: collected from you.
  • Disclosure for a business purpose: shared with our processor Shopify and with our fulfilment partner Kubbo.

Customer support information

  • Examples of Personal Information collected: name, billing address, delivery address, payment information (including credit card numbers), email address, and phone number.
  • Purpose of collection: to provide customer support.
  • Source of collection: collected from you.

Using Personal Information

We use your personal Information to provide our services to you, which includes offering products for sale, processing payments, delivery, and fulfilment of your order, and keeping you up to date on new products, services, and offers.

Lawful basis

Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), we process your personal information under the following lawful bases:

  • Your consent.
  • The performance of the contract between you and the Site.
  • Compliance with our legal obligations
  • For our legitimate interests, which do not override your fundamental rights and freedoms.

Retention

Sharing Personal Information

We share your Personal Information with the following service providers to help us provide our services and fulfil our contracts with you, as described above. 

Shopify

Microsoft Clarity

We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioural metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising. Judge.me

We use Judge.me to manage our product reviews on Simply Spanish Wine. Judge.me only collect personal data that is essential for running services and supporting us in providing the best experience to reviewers. 

Judge.me do not use personal data for any other purposes than what has been agreed with us to provide our online reviews service. Judge.me are now among the top 50 privacy-dedicated companies, according to Mine’s Privacy Index.

Google Analytics

We use Google Analytics to collect data that allows us to understand how you interact with our website. These insights allow us to improve content and build better features that enhance your experience.

Google Analytics uses a set of cookies to collect information and report site usage statistics without personally identifying individual visitors to our site. ‘_ga’, the main cookie used by Google Analytics, enables us to distinguish one visitor from another and lasts for 2 years. Any site that implements Google Analytics, including Google services, uses the ‘_ga’ cookie. Each ‘_ga’ cookie is unique to the specific property, so it cannot be used to track a given user or browser across unrelated websites.

Facebook and Google Advertising

We use Facebook and Google on our site with audience permission. This means that if you accept our use of tracking cookies and have these apps running in the background, your behaviour on our site will be fed back into these sites to provide you with more relevant ads based on demographics and interests. This information may be matched to information that these social media sites already have about you. This information may then be “hashed” (combined with other user information to make it anonymised) and used to inform Facebook Custom audiences which helps advertisers and small business like us show our ads to people who may be interested in them.

Our use of this technology might mean that you may see Simply Spanish Wine adverts when you visit Facebook.

We also use Google Advertising cookies to gain a better understanding of who visits our website and how people behave on our site, we may use this information to inform our ads based on demographics who we think would be interested in our products. Google may use the information collected to provide you with more relevant ads across their services.

    Cookies

      Automatic decision-making

      If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

      We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

      Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

      Services that include elements of automated decision-making include:

      • Temporary deny list of IP addresses associated with repeated failed transactions. This deny list persists for a small number of hours.
      • Temporary deny list of credit cards associated with deny-listed IP addresses. This deny list persists for a small number of days.

      Your rights

      GDPR

      If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. If you would like to exercise these rights, please email us on support@simplyspanishwine.com

      CCPA

      Under the California Consumer Privacy Act (CCPA), customers in California should be able to opt out of the sale of their data.

      Given we do not operate in California, and do not sell personal information we do not offer an opt-out option. However, we do comply with the guidelines outlined in the CCPA.       Minors

      The Site is not intended for individuals under the age of 18. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us on support@simplyspanishwine.com to request deletion.
